On Thursday, March 7, 2024, EPN submitted comments on EPA’s proposal to amend the definition of hazardous waste applicable to corrective action for releases from solid waste management units. We commend EPA on its decision to affirm that the Resource Conservation and Recovery Act’s (RCRA’s) corrective action plan is available to clean up listed/characteristic hazardous waste and the solid wastes that meet the statutory definition of hazardous waste. We suggest clarifying to whom the codified definition applies and is available and whether it will result in additional corrective action permits and orders being issued. We urge EPA to continue to utilize the statutory definition of hazardous waste to appropriately respond to releases under RCRA’s corrective and response action programs.
