EPN Comments on Updated Definition of “Waters of the United States”

On January 5, 2026, EPN submitted comments opposing EPA’s proposed revision to waters of the U.S. (WOTUS) definition, arguing it contradicts the Clean Water Act, ignores sound science, and would eliminate protections for most wetlands and millions of miles of streams, increasing pollution, flooding, and public health risks.

EPN also submitted an Appendix outlining several flaws in EPA’s proposed use of the WebWIMP tool as a determinant of whether an aquatic resource is considered a WOTUS. Examining areas in the Southeast, we demonstrate methodological flaws in the use of WebWIMP, resulting in potential misidentification of jurisdictional waters of the United States.
