EPN Comments on EPA’s Coal Combustion Residuals Part A and Part B Implementation

On February 23, 2022, EPN submitted comments on EPA’s Coal Combustion Residuals (CCR) Part A and Part B Implementation. Overall, EPN supports EPA’s Part A analysis, which is multifaceted, comprehensive, and consistent with the effective federal regulations to conclude incompleteness, ineligibility, denial, or tentative approval of CCRs. While EPA did not request comments on Part B implementation, the limited or lack of containment control at seven CCR surface impoundments is of major concern, and EPN encourages the agency to fully adjudicate the Part B implementation. EPN also urged all coal-fired power plants to immediately implement EPA’s clearly articulated environmental safeguards that are needed to ensure protectiveness when managing CCRs.
