On Thursday, December 14, 2023, EPN submitted comments on the Environmental Protection Agency’s (EPA) proposed rule “Procedures for Chemical Risk Evaluation Under the Toxic Substances Control Act (TSCA).” We suggested that each condition of use (COU) continue to be presented in order to establish a chemical’s risk determination. We made recommendations regarding COUs and expressed concerns regarding the stamina of EPA’s ability to add overburdened communities to the list of subpopulations that fall within the scope of an assessment.
